A. CONSENT TO DATA PROCESSING

By agreeing to this Privacy Policy, you are deemed to: (i) have read, understood, and agreed to all the terms in this Privacy Policy, and (ii) have given your consent to us to Process your Personal Data in accordance with this Privacy Policy. If you disclose any Personal Data, whether general or specific, belonging to and/or related to "Other Parties" (such as a spouse, family members, children, employees, or other Data Subjects besides the provider of the Personal Data) for any purpose related to the use of our Services, you affirm and warrant that you have obtained the necessary consent from those Other Parties as the owners of the Personal Data to disclose it to us. However, any rights and obligations arising from the contractual relationship between you and us must still be fulfilled.

If you are a service provider, we use your data to match the services you provide with users, manage your registered account, communicate with you, and provide features, facilities, and functionalities available within the scope of your services.

We also use the Personal Data we collect to maintain our system, tailor our products and Services to your preferences, and market products, facilities, promotions, and other services to you. This includes marketing by us, our affiliates, partners, agents, and third parties designated under cooperation agreements (subject to your consent as required by applicable laws and regulations).

We will retain your Personal Data for the duration of processing to meet legal obligations, for as long as the Personal Data remains within the retention period determined by us in accordance with Applicable Laws and Regulations, and/or as long as the Personal Data relates to the purposes present at the time the information was collected.

WHAT PERSONAL DATA WE COLLECT

"Personal Data" refers to any information about an individual that is identified or can be identified, either directly or indirectly, alone or in combination with other information, through electronic or non-electronic systems.

Personal Data is divided into two (2) classifications: Specific Personal Data and General Personal Data. General Personal Data includes full name, gender, nationality, religion, marital status, and/or Personal Data combined to identify an individual (including but not limited to passport and other identities such as photo, phone number of Users and non-Users in your contact list). Specific Personal Data includes health data and information, biometric data, genetic data, criminal records, children's personal data, personal financial data, and/or other data as required by applicable regulations. Furthermore, any data linked to and/or combined with Personal Data will also be classified as Personal Data.

In this Privacy Policy, applicable law means all laws, regulations, provisions, policies, government or other state authority approvals, court decisions, policy guidelines, that apply up to and including the publication of this Privacy Policy and for as long as this Privacy Policy remains in effect, including but not limited to Law Number 27 of 2022 concerning Personal Data Protection and its implementing regulations ("Applicable Laws").

All Personal Data we collect depends on the classification of data required according to the basis, purpose, and circumstances of its collection within the Personal Data Processing cycle. Additionally, the Personal Data we collect relates to the needs of the Services or the transaction activity patterns you perform within our Services.

In accordance with the Applicable Laws, we obtain, collect, process, analyze, store, correct, update, display, announce, transfer, disseminate, disclose, and/or delete and destroy the Personal Data that we classify as follows:
1. Individual Data includes full name, National Identification Card (KTP), Taxpayer Identification Number (NPWP), gender, place and date of birth, membership number, address as found on your official identity documents, residential address, shipping address, email address, mobile phone number, home phone number, and may also include individual data related to the Company, such as the full name of the CEO or representative of the entity, the full name of the person in charge, the NPWP and KTP of the person in charge, their phone number, and email address.
2. Transaction Data includes purchase or order history, interests, preferences, feedback and suggestions, survey responses from you, in relation to Users, the type of services sought, details regarding pickup and/or delivery, and the types of services that can be provided at the time.
3. Financial and Payment Data includes bank account details and payment card information such as the type of card or payment account used, the name of the card or payment account issuer, the name of the cardholder or account holder, the account or card identification number, the card's security code, and the expiration date of the payment card or account, as applicable, virtual account data, financial history (including but not limited to payment card or account transaction history, card/account details, usage/payment data, recipient details (including their account details), payment methods used, amount paid, billing details, and invoice details.
4. Technical Data includes details about your use of our Services, such as user-generated identification (user ID), in-app ordering services, in-app search services, Internet Protocol (IP) address, data about web pages viewed before or after, the duration of each visit/session, device identification (ID), Media Access Control (MAC) address, advertising ID, and other device information including details about the manufacturer, model, and operating system of the device you use to access the application, crash logs, and information regarding apps installed on your device.
5. Device Data includes device data such as the type of device you use to access the application, including hardware model, operating system and version, software, IMEI number, file name and version, language preferences, unique device identifiers, advertising identifiers, serial number, device movement information, and/or mobile network information.
6. Log Data includes records on the server that receives data, such as the device's IP address, date and time of access, features of the service or pages viewed, service processes, and other system activities, browser type, and/or third-party sites or services used by the User before interacting with the Service.
7. Location Data includes real-time (live) geographic location data of your device.
We may:
1. Create, use, license, or disclose a combination of your Personal Data in the form of statistical or demographic data for any reasonable purpose. Aggregated Data may be derived from your Personal Data but will not be considered Personal Data as it will not directly or indirectly disclose your identity; and/or
2. Create, use, license, or disclose available Personal Data, provided that to do both of the above, we will ensure that: (i) the elements to identify a specific individual have been removed in such a way that the data, alone or together with other available data, cannot be linked or connected to, or identify, anyone, and (ii) the data is then aggregated with similar data so that the original data forms part of a larger data set.
HOW WE COLLECT YOUR PERSONAL DATA

The Personal Data we collect may be provided by you directly or by third parties (e.g., when you register or use the Service, contact our customer service, or otherwise provide us with Personal Data). We may collect data in various forms and for various purposes (including purposes permitted by the applicable laws and regulations), as follows:

  2. Use the Service, including if you register as a vendor or use the Service as a user;

  4. Register as an account owner or verified user of an electronic money facility;
  5. Add funding sources for payments on the Service; and

2. Data We Collect Every Time You Use the Service
  You may provide us with Technical Data, Device Data, Log Data, and/or Location Data every time you use and/or visit the Service. Whenever you access the Service through your mobile device, we will track and collect your real-time geographical location. In some situations, you will be asked to enable the Global Positioning System (GPS) on your mobile device so that we can provide you with a better experience using the Service (for example, to identify the nearest retail store). You can always choose to disable location tracking on your mobile device temporarily, but this may affect the functionality available on the Service.
  
  If you use and/or make payments or transfers through the available electronic money facilities and/or e-wallets on our Service (either as a payer or recipient), we may collect certain Financial Data and Payment Data related to those payments and transfers.
  
  Additionally, every time you use and/or visit the Service, certain information may be automatically collected through cookies. Cookies are data sent from the site and stored on your computer or electronic device when you use our Service, recording data about, including but not limited to, your computer or electronic device; web browser information; when you access our Service; and activities you perform while using our Service. Specifically, when you register a payment card or account via the Service and/or access, add, and/or link your payment card or account to the Service, we may collect certain financial information and your financial records (including but not limited to transaction records, payment card or account details and placement, and/or the status and country of your payment card or account) from the issuer of the payment credentials or from other third parties.
4. Data We Collect About Third Parties You Provide to Us
  You may provide us with Personal Data related to third-party individuals (including Personal Data related to your partner, family members, friends, or other individuals). In such cases, you hereby declare that you have obtained the consent of the third-party individual to disclose their data to us.   When we collect your Personal Data that you provide directly, through the Service, from third parties, or Personal Data about third parties you provide to us, based on the law and/or agreements we have with you, if you fail to provide such Personal Data or fail to provide incomplete Personal Data when required, we may not be able to implement the Service or fulfill our agreement with you that is already in place and/or being formulated.
Purpose of Utilization and Processing of Personal Data

We may use the collected Personal Data for the following purposes, as well as for other purposes permitted by the Applicable Laws and Regulations ("Purposes"):

When Personal Data is not required to be linked to you, we will make reasonable efforts to remove elements in that Personal Data that can identify you before disclosing or granting access to the data to the relevant third parties.

How We Retain Your Personal Data
Your Personal Data will only be stored as long as necessary to fulfill the purposes of its collection, or for the retention period required or permitted by applicable laws and regulations. We will stop storing your Personal Data once it is determined that the data is no longer needed for the purposes of Personal Data Processing, upon withdrawal of your consent for the processing, upon your request, or when storage is no longer required for business purposes or to comply with legal obligations.

We will delete and/or remove identifiable elements from the Personal Data under our control when (i) the data is no longer required to fulfill its collection purpose; (ii) the retention period has ended; and (iii) storage is no longer necessary for compliance with applicable laws and regulations..

However, it is important to note that some of your Personal Data may still be stored or controlled by other parties, including government institutions, in certain ways. If we share your Personal Data with the relevant government institutions and/or other institutions designated by the competent government authorities or collaborating with us, you acknowledge and agree that the storage of your Personal Data by these institutions will follow their respective data retention policies.

Data communicated between users and service providers outside the use of our Service (such as via phone calls, SMS, mobile messages, or other communication methods, as well as the collection of your Personal Data by our agents) may also be stored in various ways. We do not allow the processing of Personal Data between users and service providers outside of our Service. Therefore, users and service providers are fully responsible for the processing of Personal Data in such cases.

To the extent permitted by applicable laws and regulations, you release us from any and all claims, losses, liabilities, costs, damages, and expenses (including but not limited to legal fees and full indemnification expenses) arising directly or indirectly from any activities conducted outside of our Services.

In the event your Personal Data is stolen due to malicious software, malware, and/or viruses originating from your device, we will not be held responsible for such risks.

Therefore, you are responsible for maintaining the confidentiality of your account details, and you must not share your account details, including your password and One-Time Password (OTP), with anyone. You are also required to always maintain and be responsible for the security of the device you use.
